These Terms of Service (the “Terms”) are a legal agreement between TubeTuner (“TubeTuner,” “we,” “us,” or “our”) and you (“you” or “your”). They govern your access to and use of TubeTuner’s websites, browser extensions, mobile or desktop apps, APIs, and related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

TubeTuner is an independent service and is not affiliated with, endorsed by, or sponsored by YouTube, Google, or any other platform.

‍Legal entity disclosure. To reduce harassment and abuse risks, TubeTuner does not publicly list full corporate identity information in this document. We will promptly provide legally required details (including registered entity name and service address) to customers upon reasonable request or where required by law, court order, or payment provider.

You must be at least 18 years old and capable of forming a binding contract to use the Service. If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity.

You must provide accurate and complete information when creating your account and keep your credentials secure. You are responsible for all activities under your account. Notify us immediately if you suspect unauthorized use. We may require multi-factor authentication and may suspend accounts that present a security risk.

TubeTuner may integrate with YouTube or other third party services. Your use of those services is subject to their own terms, policies, and rules. You are solely responsible for understanding and complying with all third party requirements, including the YouTube Terms of Service and any relevant Google policies, including the Google Privacy Policy. TubeTuner is not responsible for the actions or decisions of YouTube or other platforms, including account restrictions, demonetization, content removals, strikes, or terminations.

Important: You acknowledge and agree that TubeTuner cannot and does not guarantee any outcome with any third party platform and is not liable for any suspension, termination, limitation, penalty, or enforcement action applied by YouTube or any other platform.

If you connect a YouTube channel or Google account, TubeTuner may use YouTube API Services and Google OAuth to access data you authorize. By enabling these features, you agree to be bound by the YouTube Terms of Service and relevant Google policies.

You may revoke TubeTuner’s access at any time in your Google Account permissions at myaccount.google.com/permissions. Some features will stop working after revocation. Revoking access does not affect data we have already processed in accordance with these Terms and our Privacy Policy.

We require you to maintain accurate channel permissions inside YouTube Studio and to avoid sharing credentials with unauthorized parties. You agree not to attempt to exceed or circumvent API limitations, quotas, or consent flows.

TubeTuner is offered on a subscription basis with plan tiers and usage limits.

● Auto-renewal. Unless otherwise stated, subscriptions renew automatically at the end of each billing period. You can cancel at any time in your account settings, and you will retain access until the end of the current paid period.

● Trials and promotions. Free trials and promotional offers are subject to the posted terms at the time of sign-up and may change or end at our discretion.

● Taxes. Prices exclude all applicable taxes, duties, and government charges, which you are responsible to pay.
‍
● Price changes.Plans and pricing are subject to change at any time. If we change prices or materially change plan features, we will provide notice by email or in-app. New prices take effect on your next renewal or new order. Your continued use of the Service after the effective date means you accept the change.

Charges are billed to the payment method you provide. You authorize us to charge all fees for the subscription term and any usage-based or add-on fees.

Unless required by law or expressly stated otherwise in a posted refund policy, all fees are non-refundable and the Service is prepaid for the period selected. If you believe a charge is incorrect, you must notify us within 15 days.

Initiating a payment dispute or chargeback without contacting us first may result in immediate suspension or termination of access. We reserve the right to refer unpaid amounts to collections and to recover reasonable costs and fees.

You agree not to, and not to allow others to:

● Violate any platform policy, law, or regulation.

● Infringe or misappropriate any person’s intellectual property or privacy rights.
‍
● Upload or generate content that is unlawful, harmful, deceptive, defamatory, harassing, hateful, or otherwise objectionable.

● Attempt to scrape, harvest, or collect data from the Service, YouTube, or other platforms in a manner that violates their terms or privacy rules.

● Interfere with or disrupt the Service, bypass security or technical limitations, or reverse engineer any part of the Service except as permitted by law.

● Use the Service to develop a competing product or to benchmark in a misleading way.

We may suspend or terminate your access for suspected violations.

You retain ownership of the content you upload or connect to the Service. To operate and improve the Service, you grant TubeTuner a worldwide, nonexclusive, royalty-free license to host, store, process, adapt, and display your content solely to provide the Service to you and to maintain our systems. This license ends when your content is deleted from our systems, subject to routine backups and archival copies that will be deleted in the ordinary course.

You represent and warrant that you have all rights necessary to grant the license and that your content and use of the Service comply with all laws and third party terms.

TubeTuner may provide AI generated suggestions such as titles, descriptions, tags, thumbnails, and strategy tips. AI output can be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing, validating, and editing any output before use or publication. No result, ranking, monetization, or compliance outcome is guaranteed.

‍TubeTuner does not provide legal, financial, tax, or compliance advice. Any information supplied through the Service is for general informational purposes.

Our collection and use of personal data is described in our Privacy Policy. By using the Service you consent to those practices. If your use requires a data processing agreement, you may contact us to request one for eligible paid plans.

The Service, including software, features, and content provided by TubeTuner, is protected by intellectual property laws. Except for the limited rights expressly granted, we reserve all rights. You may not remove proprietary notices or use our marks without written permission. You grant us a nonexclusive, royalty-free, worldwide license to use your name and logo to identify you as a customer, unless you opt out by emailing support.

We may update, change, or discontinue any part of the Service at any time. We may modify these Terms by posting an updated version with a new effective date. If a change is material, we will provide notice by email or in-app. Your continued use after the effective date constitutes acceptance.

We design features to align with public platform guidelines, but platform rules can change without notice and enforcement is outside our control. You accept the risk of any platform action that may result from your content or your configuration of the Service.

‍To the maximum extent permitted by law, TubeTuner is not responsible for any action taken by YouTube or any other platform against you or your accounts. This includes suspensions, strikes, removals, age restrictions, demonetization, ranking changes, or terminations, even if such actions occur while or after you use the Service.

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, TubeTuner disclaims all warranties and conditions of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, noninfringement, and availability. We do not warrant that the Service will be uninterrupted, timely, secure, or error free, or that results will be accurate or meet your requirements.

The Service is not designed or intended for use in high risk environments that require fail-safe performance.

To the fullest extent permitted by law, TubeTuner and its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, or business interruption, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to the Service will not exceed the greater of:

● the amounts you paid to TubeTuner for the Service in the 12 months before the event giving rise to the liability, or

● one hundred U.S. dollars (USD 100).

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

You will defend, indemnify, and hold harmless TubeTuner and its affiliates, officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to:

● your content,

● your use or misuse of the Service,

● your violation of these Terms, laws, or third party rights, or

● any dispute between you and any platform, channel owner, collaborator, or third party.

We may assume the exclusive defense and control of any matter subject to indemnification, in which case you will cooperate with us.

You may stop using the Service at any time. We may suspend or terminate access immediately if we believe you have violated these Terms, pose a risk to the Service or others, fail to pay fees, or if required by law. Upon termination, your right to use the Service ends and we may delete your content and data in the ordinary course, subject to any legal obligations to retain certain records.

Sections that by their nature should survive will survive termination, including payment obligations, ownership, disclaimers, limitations of liability, indemnities, and dispute resolution.

These Terms and any dispute or claim will be governed by the laws of England and Wales, without regard to conflict of laws rules.

‍Arbitration. Any dispute arising out of or relating to these Terms or the Service will be finally settled by confidential binding arbitration administered by the London Court of International Arbitration (LCIA) under the LCIA Rules then in force. The seat of arbitration will be London, United Kingdom. The language will be English. The award may be entered and enforced in any court of competent jurisdiction.

‍Class action waiver. You and TubeTuner agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any class or representative action.

If arbitration is not enforceable for a particular claim, you agree to the exclusive jurisdiction and venue of the courts of England and Wales, located in London, United Kingdom.

You represent that you are not located in, under the control of, or a national or resident of any country or party subject to applicable trade sanctions or export control restrictions. You will not use the Service where prohibited by law and will comply with all export and re-export restrictions.

You consent to receive communications from us electronically. We may provide notices by email, in-app messages, or by posting on our website. Notices are effective when sent or posted. You are responsible for maintaining accurate contact information.

You may not assign or transfer these Terms or your rights without our prior written consent. We may assign these Terms without notice, including to an affiliate or in connection with a merger, acquisition, or sale of assets.

We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including natural disasters, acts of government, labor disputes, internet or telecommunications failures, or other events of force majeure.

These Terms constitute the entire agreement between you and TubeTuner regarding the Service and supersede all prior agreements on the subject. If any provision is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect. No waiver of any provision is a waiver of any other provision or of the same provision on another occasion.

You agree to keep your account information, billing details, VAT or tax information, and contact email current. We are not responsible for notices not received due to outdated information.

If you believe content accessible through the Service infringes your copyright, contact us at support@tubetuner.ai with the details required by applicable law. We may remove or disable access to alleged infringing content.

Please review the TubeTuner Privacy Policy for details on how we collect and use data, including how to request deletion. If you connect a YouTube account, you can revoke TubeTuner’s access in your Google Account permissions at any time. Some features will become unavailable after revocation.

You acknowledge that platforms such as YouTube independently apply rules, algorithms, and enforcement mechanisms. TubeTuner provides tools and suggestions only. You accept the risk that your use of the Service may have unintended effects on platform visibility, ranking, monetization, or compliance outcomes. TubeTuner is not responsible for any resulting losses.
